Terms of Business for Clients — Harrington Nannies
Introduction & Acceptance of Terms
1.1. These Terms of Business govern the introduction and engagement of candidates (including Nannies, Maternity Nurses, and Nanny/Housekeepers) by Harrington Nannies ("the Agency") to the client ("the Client").
1.2. By registering an enquiry, paying the vetting deposit, interviewing candidates, or engaging a candidate introduced by the Agency, the Client agrees to be bound by these Terms of Business in full.
2. Agency-Led Model & Vetting Deposit
2.1. Harrington Nannies operates an agency-led boutique service model designed to ensure the highest standards of safety, compliance, and suitability.
2.2. A £50 non-refundable vetting deposit is payable by the Client upon initial registration/enquiry. This deposit contributes towards the comprehensive background checks, verification processes, and preliminary candidate curations performed by the Agency.
3. Mandatory PAYE Employment Compliance
3.1. Harrington Nannies strictly champions legal employment standards. All placements facilitated by the Agency require mandatory PAYE (Pay As You Earn) employment compliance.
3.2. The Client agrees to act as the legal employer of the candidate, assume full responsibility for registering as an employer with HMRC (or utilizing a reputable payroll management service approved by the Agency), and deduct appropriate income tax and National Insurance contributions.
3.3. The Agency maintains a strict policy against cash-in-hand arrangements or non-compliant tax structures. Clients unwilling to adhere to rigid PAYE standards will not be serviced.
4. Service Scope & Role Restrictions
4.1. Nannies & Maternity Nurses: The Agency specializes in elite Nanny and Specialist Maternity Nurse placements (including Twins & Triplet support).
4.2. Nanny/Housekeeper Roles: To safeguard the primary focus on elite childcare, Nanny/Housekeeper combination roles are strictly restricted to households where all children are of school age. Infant-only or mixed households with non-school-age children are not eligible for combined Nanny/Housekeeper placements.
5. Fees and Invoicing
5.1. Introduction fees become due and payable upon the acceptance of a job offer by a candidate, or upon the candidate commencing work, whichever occurs first.
5.2. Detailed fee structures, salary guidelines, and payment schedules are outlined in the specific Schedule of Fees provided to the Client during the onboarding process. 5.3. All invoices must be settled within the specified payment terms to maintain candidate guarantees and active agency support.
6. Confidentiality & Data Protection
6.1. All candidate CVs, personal details, contact information, and vetting summaries provided by the Agency are strictly confidential and intended solely for the Client's evaluation purposes.
6.2. Clients must not share, distribute, or forward candidate information to third parties or other agencies.
7. Limitation of Liability
7.1. While the Agency conducts rigorous vetting, background checks, and reference verifications, the Client remains responsible for conducting their own interviews and final assessments before confirming an engagement.
7.2. The Agency shall not be liable for any direct or indirect loss, damage, cost, or expense arising from the introduction, employment, or conduct of any candidate, save for liability which cannot legally be excluded.
